RE: Impact of the CARES Act on Medical Benefits
Dear Sally,

As you might have heard, the Coronavirus Aid, Relief, and Economic Security (CARES) Act was signed into law as of March 27th. There's a lot of information floating around right now, so we wanted to make sure you aware of some changes in regards to your medical benefits that are already in effect.

You should be aware of and should let your employees know they can now do the following:
  • OTC items can be bought with pre-tax funds.
    After the Affordable Care Act, over-the-counter (OTC) drugs and medicines required a prescription in order to be eligible for reimbursement from an HSA or FSA. The CARES act allows individuals enrolled in these pre-tax accounts to pay for OTC drugs and medicines without a prescription. This action helps to reduce additional strain from the healthcare system. This is a permanent change. 

  • Menstrual products identified as eligible items. 
    Finally, menstrual care products were added as an eligible expense for use with an HSA and/or FSA. Menstrual care products are defined as tampons, pads, liners, menstrual cups, sponges, or similar products used by individuals with respect to menstruation. This move puts these health products in line with other already eligible expenses.
